By accepting a quote, the Client acknowledges to have read, understood, and accepted the Terms and Conditions of this Agreement, and agrees to be legally bound by these Terms and Conditions.

1. Quotes and payment
getofftheweb quotes are based on information provided by the Client. A quote may not remain accurate if the Client subsequently provides other information or changes their required specifications. Quotes are valid for 30 days.

Payment of a non-refundable deposit of 20% of the quoted price is required before work starts. The balance (including any additional amounts arising from changes made after the quote is issued) is payable upon completion.

Domain names and hosting provided by getofftheweb are payable in advance, and will be invoiced for one month before renewal date.

Payment is accepted by bank transfer or cheque.

2. Completion
The job is deemeed complete once the Client has given final approval for their site to go online.

3. Changes after completion
Changes requested by the Client after job completion will be charged at the agreed hourly rate.

4. Site updates
Clients who opt to have a content management system (CMS) for their site will be responsible for carrying out their own site updates, within the parameters of the CMS. All other changes carried out by getofftheweb will be charged for at the agreed hourly rate.

Clients who opt to have getofftheweb perform updates to their site will be charged for this work at the agreed hourly rate.

5. Copyright
All material supplied by the Client must be their own property; getofftheweb is not responsible for any breaches of copyright arising from the use of this material on the Client’s site.

getofftheweb is not responsible for the use of the Client’s material by third parties.

6. Ownership of digital files

All digital files relating to the Client's site (excluding material supplied by the Client) remain the property of getofftheweb until all relevant invoices are paid in full. Thereafter, they become the property of the Client.

7. Liability
getofftheweb will make every effort to ensure that the Client's site is designed to display and function correctly on as many browsers and operating systems as possible. Sites are designed and tested to work on Microsoft Windows and Mac OS X operating systems, running commonly used browsers including Internet Explorer, Safari, Mozilla Firefox and Chrome (latest releases). The Client agrees that getofftheweb cannot guarantee functionality across all browsers (and versions thereof), and on all operating systems.

In addition, getofftheweb cannot accept responsibility for any parts of the Client’s site that do not display or function correctly on newer versions of browsers that are released after the Client’s site has been designed.

getofftheweb will make every effort is made to ensure that site code is error free, but cannot guarantee that the display or functionality of the Client’s site will be 100% uninterrupted or error free. If errors are found in code after the Client’s site has gone online, getofftheweb will correct these free of charge. If these errors are found to arise from changes to the settings of third party domain or hosting systems made after the Client’s site has gone online, getofftheweb will charge at the agreed hourly rate to make necessary corrections to the Client’s site code.

8. Search engine listings
getofftheweb strives to create sites that are search engine friendly. However, due to the vast number of factors that search engines take into account when determining which sites to list and where to rank them, getofftheweb cannot guarantee that the Client's site will be listed by any particular search engine or guarantee any particular placement in that search engine’s listings.

After a site goes online, the time it takes to appear in search engine listings varies from one search engine to another. As rankings continuously change when new sites go online, getofftheweb cannot guarantee that the Client’s site will always keep the same ranking.

9. Client privacy
getofftheweb will not pass the Client’s details on to third parties.

10. Third party content
getofftheweb is not responsible for the content of any third party sites linked to from the Client’s site.

11. System maintenance
Hosting, domain, CMS, security and other settings may require occasional changes and/or updates. If getofftheweb manages the Client’s domain(s), and/or hosts the Client’s site, these will be carried out free of charge.

If the Client’s site is hosted by, or domain(s) managed by a third party, getofftheweb will charge at the agreed hourly rate to perform changes and/or upgrades necessary to maintain the functionality of the Client’s site.
